Please read these Terms of Service ("Terms") carefully before using the optoutscout.com website (the "Service") operated by OptOutScout LLC ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. Please note that Section 9 contains a mandatory arbitration clause and a class-action waiver, which affect your legal rights.


1. Description of Service & Authorized Agent Status

OptOutScout provides automated software tools and manual expert concierge optimization systems to assist users in locating, suppressing, and removing their public consumer profiles and data crumbs from third-party commercial data brokers, marketing lists, people search networks, and data aggregates.

  • Changing Coverage: The landscape of data collection networks shifts rapidly. We reserve the right to add, remove, or substitute supported third-party sites from our automated engine maps at any time without notice.
  • Authorized Agent Designation: By purchasing a plan, checking the acknowledgment boxes, or enabling account tracking, you explicitly designate OptOutScout LLC to act as your Authorized Agent under state and federal consumer privacy framework structures (including the California Consumer Privacy Act / CCPA, California DELETE Act, CPRA, and related state privacy statutes). This agreement constitutes your formal, signed written permission for us to act on your behalf.
  • Scope of Authorization: You grant us the express authority to interact with data syndicates solely for the purpose of locating your personal information and submitting opt-out, do-not-sell, do-not-share, access, and deletion requests. This includes the authority to fill out standard removal intake forms and execute standard declarations required by those third parties to process your requests. This authorization automatically terminates upon account closure or subscription expiration.
  • Broker Hostility & Non-Compliance: While we utilize legitimate legal frameworks to enforce deletions, certain data brokers actively display bad-faith compliance patterns, block automated privacy software, or refuse to honor Authorized Agent declarations. You acknowledge that OptOutScout LLC is not liable for a third-party broker's unlawful refusal to honor valid deletion parameters.
  • User Action Required Loops: Certain data clearinghouses require individual identity checks or direct challenge responses that a third-party entity cannot legally or structurally handle on your behalf. We will outline these entities cleanly inside your dashboard tab to allow you to easily process them directly.

2. User Representations & Prohibited Conduct

To preserve the security of our infrastructure, you warrant that you will adhere strictly to the onboarding guidelines:

  • Data Integrity: All data items, including phone coordinates, historical houses, names, and emails, must be entirely accurate and belong strictly to you, or to an individual who has granted you explicit written power of representation.
  • Stalking and Harassment Prohibited: You are strictly forbidden from utilizing our service to target, manipulate, discover, or intercept the identity profiles of an adversarial third party. Using OptOutScout to run corporate espionage, harassment, or stalking parameters will result in immediate termination and referral to law enforcement.
  • Age Restraints: You certify that you are at least 18 years of age. We explicitly bar the provisioning of minor data markers inside our user systems.
  • Geographic Footprint: The Service maps data broker systems tracking residents within the United States. You certify that you live or have lived in the United States and have legitimate U.S. consumer history.

3. Indemnification

You agree to defend, indemnify, and hold harmless OptOutScout LLC, its parent entities, affiliates, contractors, officers, directors, and software engineers from and against any and all claims, legal actions, damages, obligations, losses, liabilities, costs, or debts, including reasonable legal fees, arising out of or resulting from: (i) your misuse or fraudulent use of the Service; (ii) your violation of any condition outlined inside these Terms; or (iii) any third-party claims resulting from identity data parameters or family credentials you uploaded to your dashboard without authentic legal authorization.

4. Limitations of Liability & Disclaimers

Because our Service involves interacting with independent corporate data networks over whom we exercise zero operational control, our liabilities are strictly capped:

  • No Corporate Liability: We assume no structural liability for actions, leaks, data updates, or information exploitation that happens within third-party database nodes.
  • Transmission Disclaimers: In order to pull your record, we must transmit your target identity variables directly to data brokers to match against their active repositories. We assume zero liability for data mishandling, leakage, or security failures that occur within those third-party networks.
  • Fair Credit Reporting Act (FCRA) Disclaimer: OptOutScout LLC is not a "Consumer Reporting Agency" as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. The data displayed, monitored, or logged inside your dashboard space does not constitute a legal consumer report. You are strictly prohibited from utilizing any data obtained via the Service to establish an individual's eligibility for personal credit, insurance, employment, or tenancy evaluation frameworks.
  • Custom URL Submission Warranty: When submitting stubborn links to our team via the Custom Requests dashboard log for Google indexing removal or data broker opt-out tracking, you represent and warrant that the targeted link contains your personal information, or the personal information of an individual who has explicitly authorized you to request its removal. You agree to assume all liability for any bad-faith, inaccurate, or malicious requests to hide links not belonging to you.
  • Service "As-Is" Provisioning: The Service is deployed on an "AS IS" and "AS AVAILABLE" framework without warranties of any sort, explicit or implied. We do not warrant that our automated sweep queries will be uninterrupted, error-free, or entirely compatible with future browser configurations.

5. Subscriptions, Payments, and Refunding Thresholds

We process services uninterrupted as long as your account payment tracks safely through our authorized billing processing networks.

  • Automated Renewal Cycles: All active tiers automatically bill and renew in advance of your cycle anniversary (yearly) using your secure stored payment profile via Stripe, unless you choose to switch off renewal settings inside your billing interface prior to your billing day.
  • Resilient Guarantee Refund Window: If you are completely unsatisfied with the visibility tracking results or the progress maps inside your portal, we provide full standard conditional returns. For Premium, Couples, and Family tiers, a full refund request must be logged within 45 days of account registration. For our Baseline Essentials plan, our coverage extends to a full 150-day structural refund cycle window.
  • Cancellation Policy: You are free to deactivate account billing structures at your discretion inside your profile dashboard parameters. Upon deactivation, no further anniversary fees will execute against your card, and your system dashboard access remains open until the literal calendar termination day of your paid tracking frame cycle.

6. Intellectual Property Structures

The dashboard visuals, raw engine code paths, database configurations, site design paradigms, marketing assets, and brand assets represent the proprietary property of OptOutScout LLC and are heavily shielded under national and global copyright frameworks. You agree not to map, reproduce, re-engineer, scrape, or pass our product logic out to competing entities without explicit written corporate clearance.

7. Account Suspension & Termination

We reserve the absolute right to suspend, freeze, or terminate your system access parameters completely without notice or liability if we deduce that you have introduced fraudulent indicators, violated our core anti-stalking rules, or targeted profiles you possess no legal mandate to manage.

8. Governing Law

These Terms, along with any related operational discrepancies, will be governed strictly and constructed in complete compliance with the statutory laws of the State of Idaho in the United States, without regard to conflict of law rules.

9. Binding Arbitration & Class Action Waivers

Please read this section carefully, as it dramatically governs how you resolve legal disputes with OptOutScout LLC.

  • Mandatory Arbitration: Any legal controversy, breach claim, interpretation dispute, or statutory legal issue arising directly out of your dashboard use or subscription frameworks will be settled via binding individual arbitration rather than inside an open courtroom.
  • Administration Rules: The arbitration process will be managed exclusively by the American Arbitration Association (AAA) under its standard Consumer Arbitration Rules. The neutral arbitration procedures will take place entirely within the Comarca boundary parameters of Ada County, Idaho.
  • Class Action Waiver: Both you and OptOutScout LLC agree that all dispute resolution frameworks will be run on an individual baseline only. You completely waive any rights to pursue disputes as a plaintiff or member inside any class-action lawsuit, consolidated representation track, or public representative forum.
  • Small Claims Forum Exception: You retain the explicit right to litigate minor standalone contractual claims within small claims court formats situated explicitly in Ada County, Idaho, assuming your arguments fully align with small claims jurisdictional constraints.

10. Modifications to Terms

We reserve the exclusive right to alter these Terms at any time to account for updated privacy laws or structural changes to our data broker list. Your continued use of your profile space following the publication of revised terms constitutes an explicit acceptance of the new frameworks.
